1. GENERAL PROVISIONS
1.1. These Terms of Use (hereinafter — the "Terms") define the rules for using payment services provided by GOLDIPAY SP. Z O.O. (hereinafter — the "Provider").

2. DEFINITIONS
3.1. To access the services, the User must create an account and undergo the verification procedure (KYC).
3.2. The User is obliged to provide accurate and up-to-date data: full name, address, identity documents, and information on the source of funds (upon request).
3.3. The Provider reserves the right to refuse to open an account or provide services without providing a specific reason if such refusal is dictated by security requirements or AML internal policies.
4. PAYMENT SERVICES
4.1. The Provider offers services including execution of payment transactions, currency exchange, and maintaining payment accounts.

5.1. The current service tariffs are contained in the 'Tabela Opłat i Prowizji' (Table of Fees and Commissions) annex.
5.2. The Provider deducts the commission automatically at the time of the transaction.
5.3. The Provider reserves the right to change the fees, notifying the User at least 14 days before the changes take effect.
6. RIGHTS AND OBLIGATIONS
6.1. The User is responsible for maintaining the confidentiality of their account credentials (login, password, 2FA).
6.2. The Provider is not liable for losses caused by the User disclosing their credentials to third parties or by errors made by the User in payment instructions (e.g., incorrect recipient details).
6.3. The Provider is responsible for the correct execution of a payment transaction from the moment the payment order is received.
7. COMPLAINT PROCEDURE (REKLAMACJE)
7.1. The User has the right to file a complaint via email: legal@goldipay.io.
7.2. In accordance with Polish law, the Provider shall respond to the complaint within 15 business days. In exceptional cases, this period may be extended to 35 business days, provided the User is notified in advance.
7.3. If the User is a consumer and is not satisfied with the resolution, they may seek assistance from the Financial Ombudsman (Rzecznik Finansowy) in Poland.
8. TERMINATION AND SUSPENSION
8.1. The User may close their account at any time, provided there are no outstanding liabilities or ongoing AML investigations.
8.2. The Provider may suspend or block an account immediately upon suspicion of fraud, AML violations, or use of the service for illegal purposes.
9. FINAL PROVISIONS
9.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland.
9.2. Any disputes arising out of these Terms that cannot be settled through negotiation shall be submitted to the competent court in Warsaw, Poland.
9.3. IMPORTANT: These Terms are drafted in multiple languages. In the event of any discrepancy, the Polish version shall prevail.

- Payment Transaction — an act, initiated by the payer or on his behalf or by the payee, of placing, transferring, or withdrawing funds.
- KYC (Know Your Customer) — the process of identifying and verifying the User's identity.
- AML (Anti-Money Laundering) — measures aimed at preventing money laundering and terrorist financing.
- Business Day — any day from Monday to Friday, excluding public holidays in Poland.

- Internal transfers: processed instantly.
- External transfers: depend on correspondent banks and payment systems but generally do not exceed 1-3 business days.

1.4. Korzystając z serwisu https://goldipay.io oraz jego usług, Użytkownik potwierdza, że w pełni zapoznał się z treścią niniejszego Regulaminu i akceptuje jego postanowienia.
2. DEFINICJE
3.1. W celu korzystania z usług, Użytkownik zobowiązany jest do utworzenia konta oraz przejścia procedury weryfikacyjnej (KYC).
3.2. Użytkownik jest zobowiązany do podania prawdziwych i aktualnych danych: imienia, nazwiska, adresu zamieszkania, danych z dokumentu tożsamości oraz informacji o źródle pochodzenia środków (na żądanie).
3.3. Dostawca zastrzega sobie prawo do odmowy otwarcia konta lub świadczenia usług bez podania przyczyny, jeżeli wynika to z wymogów bezpieczeństwa lub wewnętrznych polityk AML.
4. USŁUGI PŁATNICZE
4.1. Dostawca świadczy usługi w zakresie wykonywania transakcji płatniczych, wymiany walut oraz prowadzenia rachunków płatniczych.
4.2. Terminy realizacji:
5.1. Aktualne taryfy za świadczone usługi zawarte są w załączniku Tabela Opłat i Prowizji.
5.2. Dostawca pobiera prowizję automatycznie w momencie realizacji transakcji.
5.3. Dostawca zastrzega sobie prawo do zmiany taryf, informując o tym Użytkownika z co najmniej 14-dniowym wyprzedzeniem.
6. PRAWA I OBOWIĄZKI
6.1. Użytkownik ponosi odpowiedzialność za zachowanie poufności swoich danych dostępowych (login, hasło, 2FA).
6.2. Dostawca nie ponosi odpowiedzialności za szkody powstałe w wyniku udostępnienia danych osobom trzecim lub błędy Użytkownika w instrukcjach płatniczych.
6.3. Dostawca odpowiada za prawidłową realizację transakcji od momentu przyjęcia zlecenia płatniczego do systemu.
7. PROCEDURA REKLAMACYJNA
7.1. Użytkownik ma prawo do złożenia reklamacji drogą elektroniczną na adres: legal@goldipay.io.
7.2. Dostawca rozpatruje reklamację w terminie 15 dni roboczych. W szczególnie skomplikowanych przypadkach termin może zostać wydłużony do 35 dni roboczych.
7.3. Jeżeli Użytkownik (konsument) nie jest usatysfakcjonowany, może zwrócić się o pomoc do Rzecznika Finansowego.
8. ROZWIĄZANIE UMOWY I BLOKADA KONTA
8.1. Użytkownik może zamknąć konto w dowolnym momencie, pod warunkiem braku zobowiązań finansowych.
8.2. Dostawca może natychmiast zablokować konto w przypadku podejrzenia oszustwa, naruszenia przepisów AML lub celów niezgodnych z prawem.
9. POSTANOWIENIA KOŃCOWE
9.1. Prawem właściwym jest prawo Rzeczypospolitej Polskiej.
9.2. Wszelkie spory będą rozstrzygane przez sąd właściwy dla siedziby Dostawcy w Warszawie.
9.3. Regulamin został sporządzony w kilku wersjach językowych. W przypadku rozbieżności, wersja polska jest wiążąca.

2. DEFINICJE
- Transakcja płatnicza – zainicjowana przez płatnika lub odbiorcę wpłata, transfer lub wypłata środków pieniężnych.
- KYC (Know Your Customer) – procedura identyfikacji i weryfikacji tożsamości Użytkownika.
- AML (Anti-Money Laundering) – środki mające na celu przeciwdziałanie praniu pieniędzy oraz finansowaniu terroryzmu.
- Dzień roboczy – każdy dzień od poniedziałku do piątku, z wyłączeniem dni ustawowo wolnych od pracy w Polsce.

- Przelewy wewnętrzne realizowane są natychmiastowo.
- Terminy przelewów zewnętrznych zależą od banków pośredniczących, jednak zazwyczaj nie przekraczają 1-3 dni roboczych.
- 4.3. Limity: Dostawca może nakładać indywidualne limity na Użytkowników.
5.1. Aktualne taryfy za świadczone usługi zawarte są w załączniku Tabela Opłat i Prowizji.
5.2. Dostawca pobiera prowizję automatycznie w momencie realizacji transakcji.
5.3. Dostawca zastrzega sobie prawo do zmiany taryf, informując o tym Użytkownika z co najmniej 14-dniowym wyprzedzeniem.
6. PRAWA I OBOWIĄZKI
